Under California law (Civil Code § 1786.10-1786.40), an “investigative consumer report” is a consumer report containing information on a consumer’s character, general reputation, personal characteristics or mode of living.   Under California law, ApplyConnect compiles “investigative consumer reports” about individuals and provides them to businesses for background screening related to tenancy and employment purposes, including whether to rent or lease residential property or whether to hire, promote or retain an individual.

PERSONAL INFORMATION DISCLOSURE: UNITED STATES OR OVERSEAS

In connection with our preparation and processing of “investigative consumer reports” under California law, we are required to advise you whether personal information about you is transferred to authorized service providers and affiliates outside the United States and its territories. ApplyConnect does not transfer personal information about you outside the United States and its territories.

PRIVACY PRACTICES

ApplyConnect’s policies and procedures for preparing and processing investigative consumer reports are designed to comply with the requirements of the California Investigative Consumer Reporting Agencies Act (Cal. Civ. Code § 1786.10 et. seq.) and the federal Fair Credit Reporting Act (15 U.S.C. § 1681 et. seq.).   ApplyConnect, for example, maintains policies and procedures designed to limit the purposes for, and circumstances under which, we furnish investigative consumer reports. ApplyConnect maintains reasonable procedures to assure maximum possible accuracy of the information concerning the individual about whom the report relates. ApplyConnect provides individuals with the ability to request, upon proper identification, access to information we hold about them in our investigative consumer reporting files. ApplyConnect conducts reinvestigations of the accuracy and completeness of information at the individual’s request. ApplyConnect also has implemented administrative, technical and physical safeguards designed to protect the information that ApplyConnect maintains in our investigative consumer reporting files.

CALIFORNIA CONSUMER PRIVACY ACT 2018

In compliance with CA Civ 1798.100 as amended and by CA AB 375, (which takes effect on January 1, 2020), and in cooperation with the spirit of the General Data Protection Regulation (GDPR) as enacted by the European Union, upon request, ApplyConnect will remove consumer PII data that would be stored on ApplyConnect’s systems, with the exception of archival reports pulled prior to the request for removal. Said archival reports must remain on our system for a period of not less than 6 years and one additional year for discovery to effectively comply with the Fair Credit Reporting Act (FCRA).
